Partner or Spouse Visas (subclass 801/820): applying in Australia

The Subclass 820 is a temporary visa intended for the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand to live in Australia. Once the applicant has held subclass 820 visa for two years, they may be granted the permanent subclass 801 visa if the couple can show:

  • that the relationship is genuine and continuing;
  • there is a mutual commitment to a shared life to the exclusion of all others.

Note: Some relationships are eligible for the permanent visa without the waiting period, by applying for a waiver (e.g. if relationship is over three years, or over two years with dependent children).

Outline of eligibility requirements – 820/801 visa

The visa applicant will need to demonstrate that:

  • they are married or in a de facto relationship with an Australian citizen, permanent resident or eligible New Zealand
  • their partner meets the sponsorship requirements

How much does this visa cost?

The below is an estimate of the relevant government lodgement fees (subject to change) and assumes that the applicant does not hold previous partner visas:

  • Base application fee: $6865
  • Non-internet Application Charge: N/A
  • Additional applicant charge for each additional adult that is 18 years and over: $3435
  • Additional applicant charge for each additional adult that is 18 years or under: $1720

Prospective Marriage Visas (subclass 300): fiancée visa

The Prospective Marriage visa (subclass 300) is for people who want to come to Australia to marry their prospective spouse. The temporary visa is valid for nine months. You must be outside Australia when you lodge your application and when the visa is granted.

You must marry your prospective spouse before your visa ends. The marriage can take place in or outside Australia.

Outline of eligibility requirements – 300 visa

The visa applicant will need to demonstrate that:

  • they intend to marry an Australian citizen, permanent resident or eligible New Zealand

How much does this visa cost?

  • Base application fee: $6865
  • Non-internet Application Charge: N/A
  • Additional applicant charge for each additional adult that is 18 years and over: $3435
  • Additional applicant charge for each additional adult that is 18 years or under: $1720

Partner (Provisional) visa (subclass 309) and Partner (Migrant) visa (subclass 100): applying outside Australia

The Subclass 309 is a temporary visa intended for the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand to live in Australia. This visa is applied from outside of Australia and is a two stage process to a permanent visa but one application lodgement is required. Once the applicant has held subclass 109 visa for about two years, they may be granted the permanent subclass 109 visa if the couple can show:

  • that the relationship is genuine and continuing;
  • they are living together or if you don’t live together then any separation must be temporary.

Note: Some relationships are eligible for the permanent visa without the two year waiting period (e.g. if relationship is over three years, or over two years with dependent children. Or if your partner holds or held a permanent humanitarian visa and you were in the relationship before the visa was granted and this relationship was declared to the department at the time).

Outline of eligibility requirements – 309/109 visa

The visa applicant will need to demonstrate that:

  • they are married to or in a de facto relationship for at least a year with someone who is an Australian citizen, permanent resident or eligible New Zealand.
  • their partner meets the sponsorship requirements
